DiveOpsTerms of Use

DiveOps is an app for public-safety dive teams, built by KVC, Inc. These terms cover using it. By signing in, you agree to them.
DiveOps is a record-keeping tool, not a safety device and not a medical device. It does not measure anything, decide anything, or replace the judgement of a dive supervisor. Never rely on it to make a diver safe.
Who can use it
DiveOps is for members of a dive team that uses it. You do not sign yourself up — an administrator on your team creates your account and invites you. Accounts are personal: do not share your password, and do not sign in as anyone else.
Your team's administrators decide who has an account, what each person can see, and when an account is closed.
What the app does, and what it does not do
The app records the team's schedule, attendance, hours, dive logs, and the medical checks carried out around a dive.
- Every reading is typed in by a person. The app takes no measurements. It has no access to your phone's sensors or to Apple Health.
- It does not diagnose. When a reading differs from a diver's own baseline the app highlights it. That is a prompt for a qualified person to look, nothing more. Deciding whether someone dives is a human decision, made by the people on the dive.
- It is not for emergencies. Do not use DiveOps to call for help or to report an emergency. Use your radio and your normal dispatch procedures.
Using it properly
You agree to:
- enter information accurately, particularly anything about a dive or a diver's condition;
- treat what you see as confidential — the app contains other people's addresses, emergency contacts and health information, and none of it is yours to pass on;
- use it only for your team's work;
- not try to reach records your role does not give you, or interfere with how the app works.
Misuse can have your access withdrawn by your team, and where personal or health information is involved it may have consequences beyond the app.
Availability
We aim to keep DiveOps running and reliable, but it can be unavailable — maintenance, a network failure, a hosting problem, or something we did not foresee. Some features work offline and sync when signal returns; others need a connection.
Plan on the basis that the app may not be available when you need it, and keep whatever paper or radio fallback your team would use anyway.
Your team's records
The records in DiveOps belong to your dive team. KVC, Inc. holds them on the team's behalf and does not use them for anything else. If your team stops using DiveOps, its data can be exported to it on request.
Dive logs and medical checks are kept permanently as part of the team's operational and legal record, including after a member leaves. This is set out in the Privacy Policy.
The app itself
DiveOps, including its design and its software, is the property of KVC, Inc. Using it does not transfer any ownership. Do not copy, resell, or attempt to recreate it from the app.
Liability
DiveOps is provided as it is, without warranties of any kind. To the fullest extent the law allows, KVC, Inc. is not liable for any loss, injury, or damage arising from using it or from being unable to use it — including any decision made, or not made, on the basis of what the app displayed.
Nothing here limits liability that cannot be limited by law.
Changes
These terms may change. The date at the top changes with them, and significant changes are told to teams directly. Continuing to use the app after a change means accepting it.
Governing law
These terms are governed by the laws of the State of Minnesota.
